These Terms & Conditions (“Terms”) govern access to and use of the Finerealty platform (the “Platform”).
The Privacy Policy forms an integral part of these Terms and governs the processing of personal data.
Scope of Services
Finerealty provides a cloud-based software platform for real estate portfolio management, document storage, financial tracking, analytics and related features.
The Platform is provided as Software-as-a-Service (SaaS). No ownership rights in the software are transferred to the User.
The Platform is provided on an “as is” and “as available” basis. The Company does not guarantee uninterrupted availability, continuous uptime, or error-free operation.
The Company may modify, update, suspend, improve or discontinue features at its discretion.
User Eligibility
The Platform may be used by businesses (B2B) and consumers (B2C).
By registering, the User represents and warrants that:
They are at least 18 years of age;
All information provided is accurate and complete.
If registering on behalf of a legal entity, the User represents that they are authorized to bind such entity.
If the User qualifies as a consumer under applicable law, mandatory consumer protection laws of the User’s country of residence remain unaffected.
Account Registration and Security
To use the Platform, the User must create an account.
The User is responsible for:
Maintaining the confidentiality of login credentials;
All activities conducted under their account.
Account sharing is not permitted.
The Company may suspend or terminate accounts in the event of misuse, violation of these Terms, or unlawful activity.
Subscriptions, Payments and Refunds
Subscription Model
Access to the Platform is provided on a subscription basis.
Subscriptions may be billed:
Monthly; or
Annually at a discounted rate.
Subscriptions renew automatically unless cancelled before the next billing date.
b. Cancellation
Users may cancel their subscription at any time. Cancellation takes effect at the end of the current billing period.
Termination of a paid subscription ends access to paid features. The account may remain accessible with limited functionality corresponding to the free plan, where available.
c. Refund Policy
Except where required by mandatory law:
Subscription fees are non-refundable.
Annual subscriptions are non-refundable once any applicable statutory withdrawal period has expired.
No refunds are granted for unused subscription periods.
Downgrades do not entitle the User to partial refunds.
The Company may grant refunds on a goodwill basis without legal obligation.
d. Chargebacks
Unjustified or fraudulent chargebacks may result in suspension or termination of the User’s account.
Payments are processed via third-party providers (e.g., Stripe). The Company does not store full payment card details.
Statutory Withdrawal Rights (Consumers)
If the User qualifies as a consumer and mandatory withdrawal rights apply under the laws of the User’s country of residence, the User may withdraw from the contract within 14 days from the date of conclusion of the contract.
To exercise this right, the User must notify the Company by email to:

The notification must clearly state the decision to withdraw and include sufficient information to identify the account and country of residence.
If the User has requested immediate access to the Platform during the withdrawal period and subsequently withdraws, the Company may charge a proportionate amount corresponding to the services already provided up to the date of withdrawal.

Data Ownership and Use
The User retains ownership of all data uploaded to the Platform.
The User grants the Company a limited, non-exclusive, worldwide license to process such data solely for the purpose of providing, maintaining and improving the Platform.
The Company may use aggregated and fully anonymized data derived from User data for statistical, analytical and service improvement purposes, provided that such data does not identify any individual User.
Data Storage and Account Inactivity
User data is hosted within the European Union (Frankfurt region).
Users may delete their account or data at any time. Deletion is permanent and cannot be reversed.
If a paid subscription is terminated, access to paid features ends at the conclusion of the billing period. The account may remain accessible with limited functionality corresponding to the available plan level.
If an account remains inactive for 12 consecutive months (no login activity), the Company reserves the right to delete the account and associated data after providing at least 14 days prior notice via email.
Bank Integrations
The Platform may offer integration with financial institutions through licensed third-party API providers.
The Company:
Is not a financial institution;
Is not a payment service provider;
Does not provide banking services;
Does not store banking credentials.
The Company does not guarantee the availability, completeness or accuracy of banking data and shall not be liable for interruptions or errors caused by third-party providers.
Analytics and Projections
Any analytics, projections, forecasts or estimations provided through the Platform are for informational purposes only.
They do not constitute financial, investment, tax or legal advice.
The Company makes no guarantees regarding rental income, portfolio performance, property value appreciation or financial outcomes.
Acceptable Use
Users shall not:
Use the Platform for unlawful purposes;
Attempt to reverse engineer, decompile or disrupt the software;
Interfere with system integrity;
Scrape or extract data without authorization.
Intellectual Property
All intellectual property rights in the Platform remain the exclusive property of the Company.
The User receives a limited, non-exclusive, non-transferable license to use the Platform during an active subscription.
Limitation of Liability
Nothing in these Terms excludes liability for:
Intentional misconduct;
Gross negligence;
Death or personal injury where exclusion is prohibited by law.
Subject to the above, the Company’s total liability is limited to the subscription fees paid by the User in the 12 months preceding the claim.
The Company is not liable for:
Indirect or consequential damages;
Loss of profits or business interruption;
Third-party service failures;
External data inaccuracies;
Banking API interruptions.
Amendments
The Company may amend these Terms with at least 30 days’ prior notice via email.
Continued use of the Platform after the effective date constitutes acceptance of the amended Terms.
If the User does not agree, they may terminate their subscription before the changes take effect.
Termination
Users may terminate their account at any time.
The Company may suspend or terminate accounts in the event of material breach of these Terms.
Governing Law and Jurisdiction
These Terms are governed by the laws of the United Arab Emirates.
Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Dubai (Mainland).
If the User qualifies as a consumer, mandatory consumer protection laws of the User’s country of residence remain unaffected.
